Welcome to the Family! Pass the Peaz is a mobile application that allows users to upload video and written recipes to share with their friends and family. Users can also search for other recipes, create collaborative cookbooks and interact with fellow users through the Pass the Peaz website (the “Site”), a Pass the Peaz mobile application (the “App”), and other products and accessories that we make or sell (“Products”) (collectively, our “Services”). This Privacy Policy serves to inform you, the user, of our policies and procedures regarding what personal information we collect from you, how we use it, how we store it, disclosure of your Personal Data and your rights regarding your data. For purposes of the European General Data Protection Regulation (“GDPR”) and similar data protection laws, Pass the Peaz processes your Personal Data as a data controller. This Privacy Policy is not a contact and does not create any legal rights or obligations. If you are a California resident, see the section “California Residents” for information provided pursuant to the California Consumer Privacy Act.


Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms of Use.


As used in this Privacy Policy, the terms “using” and “processing” information include subjecting the information to statistical or other analysis, and using or handling information in any way, including, but not limited to collecting, storing, evaluating, modifying, deleting, using, combining, disclosing and transferring information within Pass the Peaz or among our affiliates within the United States or internationally. 


Collection and Use of Personal Information


We collect (1) Personal Data that you have voluntarily shared with us; (2) data concerning your activity when using the Services; and (3) data that is otherwise collected through other sources. When you create an account on our App/Site, you provide us information about yourself, such as your name, phone number and email address. To build out your profile on the App/Site, you may be asked for further information, the supplying of that information is solely up to you, the user. You can also register an account by connecting to our Service through a third-party service (such as Facebook), in which case, we will collect your name and email address and other information you choose to provide on that Service will be viewable and discoverable by other users in accordance with your privacy settings on that Service.


When you use the Services, we may collect the following Personal Data:

  • Contact information, such as your first and last name, phone number, and email address;

  • Your billing information, such as your credit card number and billing address;

  • Your Pass the Peaz account information, including your user ID (assigned to your phone number) and your encrypted Pass the Peaz password;

  • Information you voluntarily provide about yourself, such as allergies, dietary restrictions, and food preferences;

  • Your user content (including video and images) you provide to use certain features, including recipes you submit, and information you provide so that we can help you manage your grocery inventory (such as photographs or video you provide to facilitate ingredient recognition features);

  • Your Usage information; and

  • Your mobile device model and ID number, user settings, location (if you enable this feature), and information about your use of the App when applicable.


Pass the Peaz and its affiliates and service providers may share this personal information with each other and use it consistent with this Privacy Policy.  The information the User provides may be combined with other information in order to provide and improve upon the user experience and help us better tailor our Services, content and advertising to our Users and understand your interests.  We will also, from time to time, use your personal information for anti-fraud purposes.


Pass the Peaz and its affiliates and service providers may also use your personal information to verify identity, provide customer service and troubleshoot.  We may also use your personal information to send you important notices and communications about User activity, updates to our terms and policies and our newsletter. 


Users may opt out of receiving these types of communications at any time by updating their preferences and/or clicking “unsubscribe” at the bottom of such communication.  If you correspond with us by email, we may retain the content of your email messages, your email address and our responses.


Your data may be shared (1) with other Users; (2) with service providers; (3) with other third-party apps and services; or (4) to comply with the law. We take measures to protect your data when we transfer it to another country. 


Once you become a Registered User, you will be able to create a profile page by submitting certain Personal Data. The profile page may be viewable by other Pass the Peaz users and will display your profile name as well as your profile picture, if you choose to upload one. You can choose what other Personal Data you provide as part of your profile. Providing such information is voluntary and should correlate with the degree of interaction you want to have with Pass the Peaz and its users. User may access, integrate, update, amend and delete your Personal Data at any time.


Many of our services and features require some Personal Data. If you choose not to provide the necessary Personal Data, you may not be able to use certain services or features. If you choose not to share your Personal Data, features that require personalization will not work for you. 


Deleting and Editing Your Privacy Information

You may request that Pass the Peaz provide you with a copy of your Personal Information, edit your Personal Information or request that we delete your Personal Information. Prior to processing your requests, we must verify the identity of the requestor to help ensure that we do not for example provide your information to another person. To edit your Personal Information, you may do so by logging into your account and going into the Settings. If you would like to delete your Personal Information, you may close your account or email privacy@passthepeaz.app.  If you would like to receive a copy of your Personal Information, please email privacy@passthepeaz.app.


Data from Third-Parties


Pass the Peaz may sometimes obtain information about you from Third-Party sources that may supplement information provided by you. For example, if you access our Services through a third-party application, such as an App Store, a social networking platform, or a third-party login service, we may collect information about you from that third-party application that you have made available via your privacy settings. 


Information Shared with Other Users


Pass the Peaz may sometimes offer various tools and functionalities that may permit you to share certain personal information, including User Content, with other users, when using our Services. 


Collection and Use of Non-Personal Information


From time to time, Pass the Peaz will collect, use and disclose non-personal information (information that does not on its own identify a specific individual) for any purpose.  This type of information may include details such as zip code, area code, location, and User preferences.  We may collect certain information to better understand user behavior and improve our services and advertising.  


Pass the Peaz may also, from time to time, collect information on how Users interact and use our App/Site and Services.  This aggregated information is considered non-personal and will be used to improve upon our services and platform. If the non-personal information is ever combined with personal information, the combined information will be treated as personal information.


Pass the Peaz’s Use of Your Name and Likeness


If you are filmed, or recorded by Pass the Peaz or its agents in connection with your participation in Pass the Peaz recipe capture, product research or promotion or otherwise in connection with your use of the Services, Pass the Peaz may display the Recording to third-parties in any form of media and by any means. California Residents


If you are a California resident, you have the right to request access to certain information we collected about you, request deletion of your Personal Data (subject to certain exceptions), and request to opt-out of the sale of your Personal Data. Under California’s Shine the Light law, you have the right to request and receive information about disclosure of your personal information to other parties for their direct marketing purposes. California residents also have the right to request that we disclose the categories of Personal Data we collected about you, and with whom we shared your Personal Data. Where appropriate or required by law, we will take reasonable steps to verify your identity prior to responding to your requests. We may deny certain requests, or fulfill a request only in part, based on our legal rights and obligations. Except as otherwise provided by the California Consumer Privacy Act, note that for purposes of this section, Personal Data does not include information about job applicants, employees and other of our personnel or information about employees and other representatives of third-party entities we may interact with. 


Minors


Pass the Peaz is not directed to children and we do not knowingly collect data from individuals under the age 16. If we become aware that we have collected Personal Data from such a child under 16 (or any other age specified by applicable law), we will take steps to delete such information from our files as soon as possible.


Data Retention


Pass the Peaz will process your Personal Data for as long as it is necessary to fulfill our Services. If you delete your account we have processes designed to delete or de-identify your Personal Data. If you do not use your account or receive emails from us for an extended period of time, we have processes designed to delete or de-identify your Personal Data.


Keep in mind that we will retain information to comply with the law, prevent fraud and protect Pass the Peaz, collect fees, resolve disputes, troubleshoot problems, assist with investigations, enforce our agreements, and take other actions permitted by law.


Disclosure to Third-Parties


Your personal information will never be sold to a third-party.  Pass the Peaz  may from time to time make certain personal information available to our affiliates and service partners to help us better enhance the User experience, our Services and personalized advertising. There may be instances (litigation, requests from public and governmental authorities) where it is necessary for Pass the Peaz to disclose your personal information.  We may also disclose information about you if we determine that for purposes of national security, law enforcement, or other issues of public importance, disclosure is necessary or appropriate.


Protection of Personal Information


The protection of your personal information is of the utmost importance to Pass the Peaz.  We will take all commercially reasonable precautions to make sure your personal information is not lost, misused, accessed, disclosed, altered or destroyed.  We will take all reasonable measures to safeguard any personal information you provide us, unfortunately, the Internet cannot be guaranteed 100% secure.  We make no representations or warranties as to the security of any personal information you submit online, which you do at your own risk.  


If you have reason to believe that your interaction with us is no longer secure, please immediately notify us of the problem by contacting us in accordance with the Contact Us section below.


Accessing Your Personal Information


We give you options to help you understand what Personal Data we use and to request that we change how we use it. You may update your personal information at any time by accessing your account. You can ask for access to your Personal Data (commonly known as making a “data subject access request”). You may ask to update or rectify the Personal Data we hold about you. Amendments and Updates


Pass the Peaz may occasionally update this Privacy Policy. The Effective Date at the top of this page is that date of the last revision of this policy. If we make any material changes we will notify you as required by law, which may include email (sent to the email address specified in your account) or by means of a notice on this website prior to the change becoming effective. We encourage you to periodically review this page for the latest information on our privacy practices.


Your continued usage of the Services following any changes means that you accept the revised Privacy Policy.
